1. Acceptance of Terms

By creating an account, accessing, or using TCGMetric (the "Service"), you agree to be bound by these Terms of Service (the "Terms"). If you do not agree to these Terms, you must not use the Service.

2. Description of Services

TCGMetric provides Pokemon Trading Card Game ("TCG") pricing data, market analytics, price trend visualizations, and predictive market intelligence tools. The platform aggregates pricing information from various third-party sources to provide estimated market values and analytical insights for informational and educational purposes.

3. Account Registration

• You must be at least 13 years old to create an account.
• Users aged 13 to 17 should have parental or guardian oversight.
• You must provide accurate, current, and complete registration information.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• TCGMetric reserves the right to suspend or terminate accounts that violate these Terms.

4. Data Accuracy Disclaimers

4.1 General Data Accuracy

All pricing data, market analytics, and predictive insights provided on TCGMetric are for informational and educational purposes only. Pricing information is provided "as is" and "as available." TCGMetric does not guarantee the accuracy, completeness, reliability, timeliness, or currency of any pricing data or analytical output. Displayed prices are estimates based on aggregated market data and are not appraisals of card value.

4.2 Not Investment or Financial Advice

Nothing on TCGMetric constitutes investment advice, financial advice, trading advice, or any other sort of professional advice. TCGMetric is not an investment adviser, appraiser, broker, or dealer. No recommendation to buy, sell, hold, or trade any collectible card is made or implied. You should conduct your own independent research and consult qualified professionals before making purchasing or selling decisions based on any information provided on this platform.

4.3 Collectible Market Risk Warning

Collectible trading cards are speculative assets whose values may fluctuate significantly based on market conditions, supply, demand, condition, and other factors. Historical pricing data and predictive analytics do not guarantee future values. There is no assurance that any card will retain or increase in value. You acknowledge that trading in collectible cards involves risk of financial loss.

5. Third-Party Data Sources and Trademarks

TCGMetric aggregates pricing data from various third-party sources. TCGMetric does not independently verify the accuracy of third-party data and makes no representations or warranties regarding such data. TCGMetric is not affiliated with, endorsed by, or sponsored by any third-party data source.

Pokemon, the Pokemon logo, and all associated character names, images, and trademarks are the property of The Pokemon Company, Nintendo, Creatures Inc., and GAME FREAK inc. TCGPlayer is a trademark of TCGPlayer, Inc. (an eBay company). All other trademarks are the property of their respective owners. TCGMetric is not affiliated with, endorsed by, or sponsored by any of these entities.

6. Intellectual Property

TCGMetric owns all rights, title, and interest in its analytics methodologies, algorithms, data compilations, visualizations, software, and original content. You receive a limited, non-exclusive, non-transferable, revocable license to access and use TCGMetric for personal, non-commercial purposes.

You may not:

• Reproduce, distribute, or publicly display TCGMetric content without prior written consent.
• Use automated means (bots, scrapers, crawlers) to access or extract data from TCGMetric.
• Redistribute, resell, or sublicense any pricing data or analytics.
• Remove or alter any proprietary notices, labels, or marks.

7. User Conduct

Prohibited activities include:

• Using automated tools to scrape or extract data.
• Attempting unauthorized access to systems or accounts.
• Redistributing or commercially exploiting pricing data.
• Impersonating any person or entity.
• Uploading malicious code or interfering with site operations.
• Using the Service for any illegal purpose.
• Circumventing the age verification system.

8. Account Termination

TCGMetric may suspend or terminate user accounts at its sole discretion, for any reason, with or without notice. Grounds for termination include but are not limited to: violation of these Terms, fraudulent or illegal activity, extended inactivity, or any conduct that TCGMetric determines is harmful to other users or the platform. Upon termination, your right to access the Service ceases immediately.

9. Disclaimer of Warranties

THE SERVICE AND ALL CONTENT, DATA, ANALYTICS, PREDICTIONS, AND INFORMATION PROVIDED THROUGH TCGMETRIC ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS, IMPLIED, OR STATUTORY. TCGMETRIC EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, RELIABILITY, NON-INFRINGEMENT, TITLE, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. TCGMETRIC DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. TCGMETRIC DOES NOT WARRANT THAT ANY PRICING DATA, MARKET ANALYSIS, OR PREDICTIVE OUTPUT IS ACCURATE, RELIABLE, COMPLETE, OR CURRENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TCGMETRIC, ITS OWNERS, OPERATORS, AFFILIATES, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, ANY PRICING DATA OR ANALYTICS PROVIDED THROUGH THE SERVICE, ANY ACTION TAKEN IN RELIANCE ON INFORMATION PROVIDED THROUGH THE SERVICE, ANY UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA, OR ANY OTHER MATTER RELATING TO THE SERVICE, REGARDLESS OF WHETHER SUCH DAMAGES ARE BASED ON WARRANTY, CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND REGARDLESS OF WHETHER TCGMETRIC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL TCGMETRIC'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF THE SERVICE EXCEED THE GREATER OF (A) ONE HUNDRED DOLLARS ($100.00) OR (B) THE TOTAL AMOUNT PAID BY YOU TO TCGMETRIC DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

11. Indemnification

You agree to defend, indemnify, and hold harmless TCGMetric, its owners, operators, affiliates, and service providers from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: your use of the Service; your violation of these Terms; your violation of any third-party rights; or any content submitted by you.

12. Dispute Resolution — Arbitration and Class Action Waiver

Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall take place in Oklahoma County, Oklahoma.

CLASS ACTION WAIVER: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.

You have a 30-day opt-out window from the date of first accepting these Terms to opt out of the arbitration provision by sending written notice to the designated contact address listed below.

Small claims exception: either party may bring an individual action in small claims court in Oklahoma County, Oklahoma if the claim falls within the court's jurisdictional limits.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Oklahoma, without regard to its conflict of law provisions. For any disputes not subject to arbitration, the exclusive jurisdiction and venue shall be the state and federal courts located in Oklahoma County, Oklahoma.

14. Modification of Terms

TCGMetric reserves the right to modify these Terms at any time. For material changes (changes to liability, arbitration, data usage, or user rights), TCGMetric will provide at least 30 days advance notice via email to registered users and/or a prominent notice on the website. Continued use of the Service after the effective date of any modifications constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must discontinue use and may request account deletion.

15. General Provisions

• Severability: If any provision is found unenforceable, remaining provisions remain in effect.
• Waiver: Failure to enforce any right does not constitute a waiver of that right.
• Assignment: TCGMetric may assign these Terms; you may not.
• Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and TCGMetric.
